These Policies for the Treatment and Protection of Personal Data (hereinafter, the “Policies”) have been prepared in accordance with the provisions contained in Articles 42 of the Political Constitution of the Republic of Panama.
1. Responsible for the Processing of Personal Data

2. Purpose and Purposes of the Processing of Personal Data
RC GROUP collects, stores and uses personal data of its customers for the purpose of forming its customer database for the following purposes: commercial, promotion and marketing of its products and services in the development of its corporate purpose.
3. Prior Authorization of RC GROUP’s customers for the Processing of Personal Data
The processing of personal data by RC GROUP requires the prior authorization of the owners of such personal data (users of RC GROUP), which must be requested, at the latest, at the time of collection of personal data.
4. Responsible for the Protection of Personal Data
The area responsible for the protection of personal data of RC GROUP, corresponds to the Marketing Area of (hereinafter, the “Responsible for the Protection of Personal Data”) who will process requests, inquiries and complaints from the holders in exercise of their right to know, update, rectify and delete their personal data, as well as revoke their authorization for the processing thereof.

Data subjects may at any time request the Personal Data Protection Officer to inform them about the Policies, and about any changes or modifications to the same.
5. Rights of the Holders
The holders of personal data shall have the following rights:
a) Know, update and rectify their personal data against RC GROUP This right may be exercised, among others, against partial, inaccurate, incomplete, fractioned, misleading, or those whose treatment is expressly prohibited or has not been authorized.
b) Request proof of the authorization granted to RC GROUP, in its capacity as data controller.
c) Be informed by RC GROUP, upon request, regarding the use it has made of your personal data.
d) To revoke the authorization and/or request the deletion of their personal data when the treatment does not respect the principles, rights and constitutional and legal guarantees.
e) Access free of charge to your personal data that have been processed.
6. Procedure for the Exercise of Rights
6.1. Right of Access to Personal Data
Holders shall have the right to know whether their personal data is being processed, as well as the scope, conditions and generalities of such processing. To this end, the holders will have the right to request the provision of their personal data to the Responsible for the Protection of Personal Data described in point 4 of this document, attaching a copy of their identity document to the request.
6.2. Right of Access to Personal Data
The owners or their assignees may consult the personal data of the owners that are in the database of RC GROUP. For such purposes, they should direct their queries to the Responsible for the Protection of Personal Data described in point 4 of this document, attaching a copy of their identity document to the request.
The Responsible for the Protection of Personal Data will respond to queries within a maximum term of ten (10) business days from the date of receipt thereof. When it is not possible to answer a certain query within such term, the Responsible for the Protection of Personal Data will inform the interested party in writing, stating the reasons for the delay and indicating the date on which the query will be answered, which in no case may exceed five (5) business days following the expiration of the first term.
Claims
The owners or their assignees who believe that the information contained in the database of RC GROUP, should be corrected, updated or deleted, or when they notice the alleged breach of any of the duties contained in Articles 42 of the Constitution of the Republic of Panama, may file a complaint with the Responsible for the Protection of Personal Data described in point 4 of this document, which will be processed under the following rules:
a) The claim shall be formulated by means of a request addressed to the Responsible for the Protection of Personal Data, with the identification of the owner, a copy of his/her identity document, a description of the facts that give rise to the claim, the address, and accompanied by the documents that he/she wishes to assert. If the claim is incomplete, the Responsible for the Protection of Personal Data will require the interested party within five (5) calendar days following the receipt of the claim to correct the faults. After two (2) months from the date of the requirement, without the applicant submitting the required information, it will be understood that the applicant has withdrawn the claim.
b) Once the completed claim has been received, a legend stating “claim in process” and the reason for the claim shall be included in the corresponding RC GROUP database, within a term not to exceed two (2) business days. Such legend shall be maintained until the claim is decided.
c) The maximum term to address the claim will be fifteen (15) business days from the day following the date of its receipt. When it is not possible to address the claim within such term, the Responsible for the Protection of Personal Data will inform the interested party the reasons for the delay and the date on which the claim will be addressed, which in no case may exceed eight (8) business days following the expiration of the first term.
6.4. Request for Revocation of Authorization and/or Deletion of Personal Data
The owners may at any time request to the Responsible for the Protection of Personal Data described in point 4 of this document the deletion of their personal data and/or revoke the authorization granted for the processing of the same, by filing a complaint.
7. Information Security
RC GROUPRC GROUP, is committed to the correct treatment of the personal data of the owners, avoiding unauthorized access by third parties that allow to know or violate, modify, disclose or destroy the information contained in its databases. For this reason, RC GROUP, has security protocols and access to their information systems, storage and processing, including physical security measures for this purpose.
8. Validity of the Policies
These Policies are effective as of the first (1) day of July 2020, and will be in force during the existence of RC GROUP. The customer database of RC GROUP, will remain in force for as long as it is reasonable and necessary, according to the purposes that justified the treatment, taking into account the provisions applicable to the matter in question and the administrative, accounting, tax, legal and historical aspects of the information.
RC GROUPin compliance with the provisions of the Political Constitution of the Republic of Panama, in its article 42, informs you that it has in its database with information previously provided by you, which has been collected for commercial and marketing purposes carried out in the development of our corporate purpose.
In accordance with our Personal Data Treatment and Protection Policies, we inform you that your personal data are treated confidentially and the Company guarantees the security, reserve and confidentiality of such data.
The Company requires your authorization to continue processing your personal data to fulfill the purposes described above.
If you wish your personal data to be excluded from the Company’s database, we request that you please inform us by writing to Ave. Samuel Lewis and 34E Street, Obarrio. Generali Tower, 20th Floor, Panama City, Telephone: 394-8712/13, e-mail[email protected] If we do not receive a communication from you within thirty (30) business days from the date of receipt of this communication, and if we do not receive a communication from you in the terms described above, the Company will be authorized by you to continue using your personal data for the same purposes.
The foregoing is without prejudice to your right to know, update, rectify and delete your personal data at any time in the terms set forth in Article 42 of the Political Constitution of the Republic of Panama.
